What the rule says
- File a written claim with the mover inside the window on the bill of lading; nine months from delivery is the common term.
- An interstate mover must acknowledge within 30 days and pay, decline, or make a firm offer within 120 days. That is 49 CFR Part 370.
- What they pay depends on the valuation you chose: 60 cents per pound per article on released value, or repair, replacement, or cash under full value protection.
Interstate rules are FMCSA rules. A move inside one state follows that state, if it has a desk. This is not legal advice.
What you do this week
- 1Write exceptions on the inventory at delivery and photograph every flagged item with its tag.
- 2Send the claim in writing with inventory numbers, photos, and what you want: repair, replacement, or cash.
- 3Ask for the arbitration program if they decline. Claims up to $10,000 can be arbitrated at your request.
